Terms and Conditions
PAYMENT, CANCELLATION, REFUND, AND RESCHEDULING POLICY
The following Payment, Cancellation, Refund, and Rescheduling Policy governs all photography services provided by The Kaleidoscope Photography. By booking a session, paying an invoice, signing a contract, or otherwise engaging our services, you agree to the terms outlined below.
1. BOOKING REQUIREMENTS
A photography session is not considered confirmed until:
The required retainer or deposit has been paid (40% of service price), if applicable;
The client has completed any required booking forms;
The client has signed any required service agreement; and
Confirmation has been issued by The Kaleidoscope Photography.
We reserve the right to decline or cancel bookings at our discretion prior to confirmation.
2. ACCEPTED PAYMENT METHODS
We currently accept payment in the following forms:
Cash
Bahamian Dollars (BSD)
United States Dollars (USD)
Electronic Payments
Bank Transfer (Bahamas-based clients)
Debit Card
Credit Card
Electronic Payment Links
Electronic Invoices
Payments are processed through secure third-party banking and payment systems.
The Kaleidoscope Photography does not accept:
PayPal
Stripe
Cryptocurrency
3. PAYMENT DEADLINES
Unless otherwise stated in writing:
Deposits or Retainers
Any required booking deposit or retainer must be paid by the date specified in the invoice.
Final Balance
The remaining balance must be paid no later than:
Twenty-four (24) hours before the scheduled session; or
Upon arrival at the session, if previously approved by The Kaleidoscope Photography.
Failure to make payment may result in cancellation of services.
No final edited images will be delivered until all outstanding balances have been paid in full.
4. LATE PAYMENTS
Any unpaid balances may result in:
Delayed delivery of photographs;
Suspension of editing services;
Cancellation of future bookings; or
Collection efforts where legally permitted.
The Kaleidoscope Photography reserves the right to withhold all deliverables until payment obligations have been satisfied.
5. CLIENT CANCELLATIONS
A cancellation occurs when a client chooses not to proceed with a scheduled photography session.
Cancellation More Than 14 Days Before Session
The client may cancel without additional fees beyond any non-refundable retainer already paid.
Cancellation 7–14 Days Before Session
Any paid retainer remains non-refundable.
Cancellation Less Than 7 Days Before Session
The Kaleidoscope Photography reserves the right to retain any payments already made due to scheduling commitments, preparation time, and lost booking opportunities.
Same-Day Cancellation
Payments already received may be retained in full.
6. NON-REFUNDABLE RETAINERS
Any booking retainer, reservation fee, or deposit paid to secure a date is non-refundable.
Retainers compensate The Kaleidoscope Photography for:
Reserving session dates;
Administrative preparation;
Client consultations;
Scheduling commitments; and
Lost opportunities to accept other bookings.
Retainers are not payments for photographs and are earned upon receipt.
7. RESCHEDULING POLICY
We understand that emergencies and unforeseen circumstances occur.
Clients may request to reschedule a session by providing notice as soon as possible.
Rescheduling Requests Made More Than 72 Hours Before Session
One reschedule may be granted without penalty, subject to availability.
Rescheduling Requests Made Within 72 Hours
Approval is at the sole discretion of The Kaleidoscope Photography.
Additional fees may apply depending on circumstances.
Multiple Rescheduling Requests
Repeated rescheduling may require a new booking fee or deposit.
8. LATE ARRIVALS
Clients are expected to arrive on time.
Grace Period
A grace period of fifteen (15) minutes may be provided.
Late Arrivals
Late arrivals may result in:
Reduced shooting time;
Modified session plans;
Fewer photographs;
Additional fees where appropriate.
The session will still end at the originally scheduled time unless otherwise agreed.
9. NO-SHOW POLICY
A no-show occurs when a client fails to attend a scheduled session without notice.
In the event of a no-show:
All deposits and retainers are forfeited;
Any remaining balance may still be owed if specified in a signed contract;
A new booking will require a new reservation fee.
10. PHOTOGRAPHER CANCELLATION
If The Kaleidoscope Photography must cancel due to:
Illness;
Injury;
Family emergency;
Equipment failure;
Severe weather;
Acts of God; or
Circumstances beyond reasonable control,
we may:
Reschedule the session; or
Issue a refund of amounts paid.
Liability is limited to the amount paid for services not rendered.
11. WEATHER POLICY
Outdoor sessions may be rescheduled when weather conditions create safety concerns or substantially affect image quality.
Examples include:
Hurricanes
Tropical storms
Lightning
Flooding
Excessive wind
Dangerous heat conditions
The decision to reschedule due to weather rests with The Kaleidoscope Photography.
Weather-related reschedules are not considered client cancellations.
12. REFUND POLICY
Due to the custom and artistic nature of photography services, refunds are generally not available once services have been performed.
Refunds will not be issued because:
A client changes their mind;
A client dislikes personal appearance in photographs;
A client prefers a different editing style after delivery;
A client fails to review portfolio examples before booking;
A client fails to communicate preferences before editing.
Photography is a creative service, and artistic judgment remains at the discretion of The Kaleidoscope Photography.
13. DIGITAL PRODUCT REFUNDS
Because digital photographs cannot be returned once delivered, all delivered digital products are non-refundable.
This includes:
Digital galleries
Edited images
Downloadable files
Digital albums
Online deliveries
14. EXCEPTIONS
Refund requests resulting from documented technical failures, duplicate charges, or billing errors will be reviewed on a case-by-case basis.
Approved refunds, if any, may take several business days to process depending on the payment provider.
15. CHARGEBACKS
Clients agree to contact The Kaleidoscope Photography before initiating a payment dispute or chargeback.
Initiating a fraudulent chargeback after receiving contracted services may result in collection efforts and legal action where permitted by law.
16. POLICY ACCEPTANCE
By booking services, paying an invoice, signing a contract, or otherwise engaging The Kaleidoscope Photography, you acknowledge that you have read, understood, and agreed to this Payment, Cancellation, Refund, and Rescheduling Policy.
